Civil Forfeiture Act, S.B.C. 2005, c. 29

The Act provides for the disposition of proceeds of unlawful activity and the acquisition of all or part of an interest, the increase in value of all or part of an interest, or the decrease in a debt obligation as defined in the definition of “proceeds of unlawful activity”.

  • Nature of Interest: If a person fails to pay or remit an amount owing under the Act, the government is entitled to a lien against real property owned by that person, an associated corporation, or a related individual.
  • Procedure for Enforcement: The director may register notice against the real property in the same manner that a charge is registered under the Land Title Act.
  • Effect of Registration: Section 23 creates a notice with the same effect as a Certificate of Pending Litigation.
  • Electronic Charge Submissions: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Certificate of Pending Litigation, and attach an image of the original Form 1 under the Civil Forfeiture Regulation.
  • Electronic Cancellation Submissions: On the Form 17 Cancellation of Charge, Notation or Filing, select Nature of Interest, Certificate of Pending Litigation, and attach an image of the original Form 3 under the Civil Forfeiture Regulation.

Note: A foreclosure order under the Civil Forfeiture Act does not require a Form 3 Discharge under that Act to release a Civil Forfeiture Act Notice if it is specifically dealt with by the foreclosure order.
