Part 6, Division 11 of the Act (ss. 164 to 168) deals with the appointment of the Public Guardian and Trustee to administer the estate of a deceased person.

In accordance with s. 164 of the Act, the Public Guardian and Trustee may apply for a grant of probate or administration of a deceased’s estate in circumstances where at the time of death, the deceased resided in British Columbia or had property in the province, and the person died intestate, or leaving a will, but without having appointed an executor willing and able to act.

Once granted probate or administration, the Public Guardian and Trustee has the rights, duties, and liabilities of an administrator with regard to the estate of the deceased.
