Petroleum and Natural Gas Act, R.S.B.C. 1996, c. 361, ss. 171, 173, and 175

  • Nature of Instrument: Order of the Surface Rights Board.
  • Filed by or in Favour of: A person whose right of entry is authorized or terminated by the order.
  • Registrar’s Requirements: A certified copy of the order must be filed with the registrar of the appropriate land title district. Upon payment of the appropriate fees, the registrar endorses the order on the land title records.
  • Assignment: A right holder may assign an order of the board. If the land subject to the order is registered under the Land Title Act, the right holder must file a certified copy of the assignment with the registrar of the appropriate land title district. Upon payment of the appropriate fees, the registrar endorses the assignment on the land title records.
  • Effect of Registration: A certified copy of the order may be filed at any time with the Supreme Court or the Provincial Court and, once filed, the order has the same force and effect, and all proceedings may be taken on it, as it if were an order of the court.
