Forest Act, R.S.B.C. 1996, c. 157

The Act provides for the designation, regulation, and maintenance of provincial forests. Section 130 creates a lien where money is payable to the government under the Act, the Forest and Range Practices Act, S.B.C. 2002, c. 69, the Wildfire Act, S.B.C. 2004, c. 31, or by virtue of any agreement or permit under the legislation or the regulations.

  • Nature of Interest: Money that is owing constitutes a lien in favour of the government on timber and other specified chattels owned by the person who owes the money.
  • Effect of Interest: Lien on timber and some chattels has priority over all other claims whether or not registered.
  • Procedure for Enforcement: The Minister of Finance may file a certificate in court for the unpaid amount and interest.
  • Electronic Submissions: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Crown Lien, and attach an image of the original certificate under the Forest Act.
  • Effect of Filing: Certificate, once filed, has the same effect as a court order for the recovery of debt.
