192 An owner developer may create sections for a strata corporation at the time the strata plan is deposited by filing in the land title office

  • (a) bylaws that provide for the creation and administration of each section, and
  • (b) any resolutions to designate limited common property, in accordance with section 74, for the exclusive use of all the strata lots in a section.

REGULATIONS AND FORMS

Owner Developers’ Notice of Different Bylaws, Form Y

An owner developer must use Form Y, Notice of Different Bylaws, to file bylaws for the creation and administration of a section.

Submissions

On the Strata Property Act Filing form, select Form Y, Owners Developers’ Notice of Different Bylaws, and attach an image of the original Form Y.

Certificate of Strata Corporation, Form E

An owner developer must use Form E, Certificate of Strata Corporation, to file a resolution designating limited common property for the exclusive use of strata lots in a section.

Submissions

On the Strata Property Act Filing form, select Form E, Certificate of Strata Corporation, and attach an image of the original Form E and any resolution.
