Industrial Operation Compensation Act, R.S.B.C. 1996, c. 222, ss. 2 and 3

  • Nature of Instrument: Agreement or award for compensation for damage to land, payable to the owner of land which is or may likely be damaged or injured by the operation of ore reduction works or an industrial plant.
  • Filed by or in Favour of: The owner of the land.
  • Effect of Registration: The payment of compensation under the terms of an agreement affords a complete answer to any action for damages or for injunction brought in respect of any matter for which compensation has been paid. In the case of an agreement, the agreement may state that it binds and enures to the benefit of the heirs, personal representative, successors, and assignees of the parties to it. In the case of an award, when registered the award binds and enures to the benefit of the heirs, personal representative, successors, and assignees of the parties to the reference.
