Cremation, Interment and Funeral Services Act, S.B.C. 2004, c. 35, ss. 25 and 27

  • Nature of Instrument: Notice of certificate of public interest.
  • Filed by or in Favour of: A director under the Business Practices and Consumer Protection Act on approval of an application for a certificate of public interest in relation to:
  • (a) the establishment of a place of interment on land,
  • (b) the enlargement of an area of land being used as a cemetery,
  • (c) the enlargement of an area of land housing a mausoleum or columbarium.
  • Registrar’s Requirements: The registrar requires that the notice be signed by director, sets out a description of the land to which the certificate relates and has a copy of the certificate of public interest attached.
  • Electronic Submissions: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Cremation, Interment and Funeral Services Act, and attach an image of the original letter and a copy of the certificate of public interest.
  • Effect of Registration: Together with s. 27 of the Act, the registration of the notice operates as a restrictive covenant, preventing the sale, lease, or encumbrance of the land of a cemetery, mausoleum, or columbarium without the permission of the director.
  • Cancellation: A notice of cancellation may be filed by the director in order to cancel the entry in the land title registry. The electronic Form C Release is the approved form for electronic filing.
  • Note: A certificate of public interest issued under s. 12 of the Cemetery and Funeral Services Act (now repealed) is deemed to be a certificate of public interest issued under s. 24 of the Cremation, Interment and Funeral Services Act.
