86 (1) If an intestate dies leaving no spouse or issue, the person’s estate goes to the person’s parents in equal shares if all the parents are living.

  • (2) If a parent of the person is dead, the estate goes
  • (a) to the surviving parent, if there is only one surviving parent, or
  • (b) to the surviving parents in equal shares, if there is more than one surviving parent.
