Aeronautics Act, R.S.C. 1985, c. A-2, s. 5.6

  • Nature of Instrument: Zoning regulation restricting use and development of land adjacent to or in the vicinity of a federal airport or an airport site.
  • Filed by or in Favour of: The minister responsible for the administration of the Act.
  • Registrar’s Requirements: The registrar requires that the zoning regulation, signed by the minister, be filed together with a plan, also signed by the minister and prepared and signed by a British Columbia land surveyor in accordance with s. 22 of the Land Title Act Regulation, B.C. Reg. 334/79.
  • Effect of Registration: The zoning regulation comes into force in respect of the lands to which it applies on deposit of the regulation and the required plan in the land title office.
  • Amendment: An amending regulation may be deposited in the land title office and comes into force upon deposit. A plan may not be required.
  • Practice: Each electronic application to deposit Airport Zoning Regulations and plan should be imaged and attached to an electronic Form 17 Charge, Notation or Filing.
  • Electronic Submissions: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Airport Zoning Regulations, and attach an image of the regulations and plan, if needed.
  • The regulations and plan will be assigned a filing number and entered in the land title records as a notation on the title.
