Securities Act, R.S.B.C. 1996, c. 418, s. 164.18

  • Nature of Instrument: Notice of proceedings with respect to real property or the whole or a portion of an interest in the real property referred to in the notice.
  • Filed by or in Favour of: The British Columbia Securities Commission, where the proceedings being taken or about to be taken may affect land belonging to the affected person.
  • Electronic Submission: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Securities Act Charge, and attach an image of the prescribed form of notice. The registrar does not send out a notice of the registration.
  • Effect of Registration: The notice has the same effect as the registration or recording of a certificate of pending litigation.
  • Amendment, Extension or Cancellation: A notice may be amended, extended or cancelled in writing, and a copy of the amendment, extension or cancellation must be filed in the land title office. For Amendments or Extensions, On the Form 17 Charge, Notation or Filing, select Nature of Interest, Securities Act Charge, Modification and attach an image of the form of notice of amendment or extension. For Cancellations, On the Form 17 Cancellation of Charge, Notation or Filing, select Nature of Interest, Securities Act Charge and attach an image of the form of notice of cancellation.
