222 (1) Before a person applies to deposit the first phase of a phased strata plan, the person must obtain the approval of an approving officer to a Phased Strata Plan Declaration in the prescribed form.

  • (2) The approval of the approving officer referred to in subsection (1) expires after one year unless the first phase is deposited before that time.

The Strata Property Regulation, B.C. Reg. 43/2000, is included at chapter 58 (Strata Property Regulations). The forms prescribed by the Strata Property Regulation are included at chapter 59 (Strata Property Forms).

Phased Strata Plan Declaration, Form P: Section 222(1)

The Strata Property Regulation prescribes Form P, Phased Strata Plan Declaration, for the purpose of s. 222(1) of the Act.

Submissions

On the Strata Property Act Filing form, select Form P, Phased Strata Plan Declaration, and attach an image of the Form P.

Fees for Phased Developments in Rural Areas: Section 222(1)

Section 13.1(a) of the Strata Property Regulation provides that if the land included in a phased development is in a rural area, the approving officer is to be paid the prescribed fee for examining Form P, Phased Strata Plan Declaration, under s. 222 of the Act.

Phased Strata Plans Under the Condominium Act: Section 222(2)

Section 17.17(1) of the Strata Property Regulation provides that s. 222(2) of the Strata Property Act does not apply to a phased strata plan for which a Form E under s. 77 of the Condominium Act has been approved by an approving officer before July 1, 2000.

PRACTICE

The registrar confirms that the application to deposit the first phase of a phased strata plan is filed within one year of the date the approving officer approved the Form P.
