267 The registrar must, if satisfied that an application and accompanying documents to amend a strata plan comply with this Act and the Land Title Act and the regulations made under those Acts,

  • (a) deposit the reference or explanatory plan,
  • (b) note the amendment on the strata plan,
  • (c) make any entry of the amendment that the registrar considers necessary on the common property record,
  • (d) file the Certificate of Strata Corporation, any certificate of compliance respecting conformity with any applicable municipal or regional district bylaws, Nisga’a Government laws or treaty first nation laws and any Schedule of Unit Entitlement or Schedule of Voting Rights,
  • (e) register any new indefeasible title and any other registrable document that the registrar has required, and
  • (f) cancel the title to any land that is being consolidated with other land.

Certificate of Strata Corporation, Form E: Section 267(d)

The Strata Property Regulation prescribes Form E, Certificate of Strata Corporation, for the purpose of s. 267(d) of the Act.

Schedule of Unit Entitlement, Form V: Section 267(d)

The Strata Property Regulation prescribes Form V, Schedule of Unit Entitlement, for the purpose of s. 267(d) of the Act.

Electronic Plans

The director has approved the use of the electronic Strata Property Act Filing form. This form is available in Web Filing using a myLTSA Enterprise account.

Form V is in the class of supporting documents designated by the director for electronic filing.

Schedule of Voting Rights, Form W: Section 267(d)

The Strata Property Regulation prescribes Form W, Schedule of Voting Rights, for the purpose of s. 267(d) of the Act.

Registration of Indefeasible Title: Section 267(e)

See s. 14.11 of the Strata Property Regulation regarding registration of indefeasible title for each strata lot.

Amended Schedule of Interest on Destruction and Certificate of Strata Corporation

See s. 17.20(5) of the Strata Property Regulation, which states that s. 267 of the Act applies to an Amendment of Interest on Destruction under ss. 259, 262, and 263 of the Act and to the Certificate of Strata Corporation under s. 262 as though these documents were listed in s. 267(d) of the Act.

See s. 249(3) of the Act, which provides that the registrar is under no duty to ensure that a Schedule of Unit Entitlement or a Schedule of Voting Rights complies with the Act or the regulations, or has been approved by the superintendent.
