South Coast British Columbia Transportation Authority Act, S.B.C. 1998, c. 30

Part 7.1 of the Act, ss. 169.01 to 169.65, provides for the establishment and administration of a parking rights tax. If a person is required and fails to pay or collect and remit a tax owing under this Part, the administrator may register a lien against the real property of that person, an associated corporation, or a related individual. The administrator registers the certificate of lien in the prescribed form in the appropriate land title office in the same manner as a charge is registered under the Land Title Act.

  • Nature of Interest: The amount owing constitutes a lien in favour of the South Coast British Columbia Transportation Authority. The prescribed form of lien is set out in the Schedule to the Parking Rights Tax Regulation, B.C. Reg. 221/2010, effective July 1, 2010.
  • Effect of Registration: The certificate, once registered, creates a lien on real property for the amount remaining unpaid, uncollected, or unremitted and any related penalty or interest on that amount.
  • Procedure for Enforcement: Prior to commencing enforcement proceedings, the administrator must give notice to the person who owes the amount.
  • Effect of Filing: An amount owing under this Part may be recovered by action in a court for recovery of the debt or for enforcement of the lien.
  • Electronic Submissions: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Crown Lien, and attach an image of the original certificate under the South Coast British Columbia Transportation Authority Act.
