Federal Real Property and Federal Immovables Act, S.C. 1991, c. 50

  • Instruments issued by Canada to implement land title transactions under the authority of the Federal Real Property and Federal Immovables Act and related to federal real property or interests in federal real property may be registered in the land title office and may, where applicable, be accompanied by a plan defining the area of land dealt with in the application for registration.
  • Reference or Explanatory Plan
  • Electronic Submissions: An electronic reference or explanatory plan with a pre-assigned plan number is attached to a Survey Plan Certification form signed electronically by a British Columbia Land Surveyor. The Survey Plan Certification accompanies the electronic Application to Deposit Plan at Land Title Office. These forms are available at ltsa.ca.
  • Application for Fee Simple Title for Federal Grant of Land
  • Electronic Submissions: On the Form 17 Fee Simple, select Nature of Interest, Federal Grant of Land, and attach an image of the original Letters Patent, Instrument of Grant, Federal Order in Council or Ministerial Order.
  • Application for First Nations Lands Title
  • On the Form 17 Fee Simple, select Nature of Interest, First Nations Lands Title, and attach an image of the applicable original supporting documents:
  • (1) a certificate of vesting under s. 373.64 of the Act signed by the chief administrative officer;
  • (2) a certificate under Schedule 1 of the Act.
  • Application for Charge, Notation, or Filing
  • Electronic Submissions: The director has approved the use of the electronic Form C Charge or Form 17 Charge, Notation or Filing. These forms are available in Web Filing using a myLTSA Enterprise account.
  • Treaty First Nation Effective Date
  • On the Form 17 Charge, Notation or Filing, select Nature of Interest, First Nations Filing, and attach an image of the original document pertaining to the effective date of a matter dealing with a treaty First Nation, such as an Order in Council, a notification of an Approving Officer or the appointment or notification of a taxation authority.
  • Reservation—Life Estate, Statutory Right of Way, Easement, or Covenant
  • Where an application in Form 17 Fee Simple for a FEDERAL GRANT OF LAND is on condition, select the charge that represents the conditional fee interest in a separate Form 17 Charge (e.g., Reservation—Life Estate) from the drop-down menu, describe as one number less than Crown Grant including a Federal grant or Form A in the additional information field, and apply an electronic signature to the electronic Form 17 or alternatively attach an image of the original Federal Grant of Land containing the reservation.
  • Right of Entry
  • Where an application in Form 17 Fee Simple for a FEDERAL GRANT OF LAND is on condition, select the charge that represents the conditional fee interest in a separate Form 17 Charge (e.g., Right of Entry) from the drop-down menu and apply an electronic signature to the electronic Form 17.
  • Describe as one number less than Crown Grant including a Federal grant or Form A in the additional information field.
  • Application for Cancellation of Charge, Notation, or Filing
  • Electronic Submissions: The director has approved the use of the electronic Form C Release or Form 17 Cancellation of Charge, Notation or Filing. These forms are available in Web Filing using a myLTSA Enterprise account.
  • Possibility of Reverter
  • A possibility of reverter may be cancelled by completing an electronic Form C Release or a Form 17 Cancellation of Charge, Notation or Filing with supporting documents attached.
  • On the Form 17 Cancellation of Charge, Notation or Filing, select Nature of Interest, Possibility of Reverter, and attach an image of the original amended Letters Patent under the Great Seal or Instrument of Grant.
  • Cancellation of Statutory Right of Way, Right of Entry, Possibility of Reverter, Quit Claim of Easement, or Mortgage
  • Electronic Submissions: The director has approved the use of the electronic Form C Release. This form is available in Web Filing using a myLTSA Enterprise account.
  • Transfer of Administration and Control
  • On the Form 17 Fee Simple, select Nature of Interest, Transfer of Administration and Control, and attach an image of the Transfer of Administration and Control.
  • A Transfer of Administration and Control from Canada to the Province of British Columbia (by Federal Order in Council or Ministerial Order) under s. 11 of the Act, and Acceptance of Transfer of Administration and Control from the Province of British Columbia to Canada (by Federal Order in Council or Ministerial Order) under s. 11 of the Act must be attached to a Form 17.
  • Note: The Federal Real Property and Federal Immovables Act provides that the Instrument of Grant and the Transfer of Administration and Control must be signed by the Federal Minister having administration of the land (or the Minister’s delegate) and countersigned by the Minister of Justice (or that Minister’s delegate). An Acceptance of Transfer of Administration and Control must also be signed by the Minister of Justice (or that Minister’s delegate). Letters Patent are signed in accordance with other federal legislative requirements.
