224 (1) Before the owner developer applies to deposit a phase of a phased strata plan, the owner developer must obtain the approval of an approving officer to that phase.

  • (2) The approving officer must approve a phase of a phased strata plan if it substantially complies with the requirements for that phase as set out in the Phased Strata Plan Declaration.
  • (3) If the approving officer approves a phase of the phased strata plan, the approving officer must endorse the approval on the plan in accordance with the regulations.

Endorsement of Approval for Phased Strata Plan, Form Q

Section 14.5(1) of the Strata Property Regulation provides that the prescribed form for the approval of a phase in a phased strata plan required by s. 224 of the Act is Form Q, Endorsement of Approval for Phased Strata Plan. Form Q is included at chapter 59 (Strata Property Forms).

Submissions

The signature of the approving officer is included in the Application to Deposit Plan at Land Title Office. On the Schedule of Approving Officers and Provincial Approvers, select Form Q from the Approval Type drop down menu.

Fees for Phased Developments in Rural Areas

Section 13.1(b) of the Strata Property Regulation provides that if the land included in a phased development is in a rural area, the approving officer is to be paid the prescribed fee for approving a strata plan under s. 224 of the Act.
