  • 66 (1) All the provisions of this Act, except Division II of this Part, in so far as they are applicable, apply, with such modifications as the circumstances require, to proposals made under this Division.

PRACTICE

Application of Act to Division I Proposals

Section 66 makes all of the provisions of the Act except ss. 66.11 to 66.4 (Division II of Part III: Consumer Proposals) applicable to proposal under Division I of Part III (General Scheme for Proposals, ss. 50 to 66).

Application for Registration of Trustee

A trustee may apply to obtain registration under a proposal in the trustee’s name as trustee of the land or interest in land of the bankrupt by filing the usual documents and the court order (or court certified copy) with proposal attached. The registrar reviews each application by a trustee under the Act.

Submissions

On the Declaration form, enter a description of the court order and attach an image of the original or court certified copy of the court order. The electronic Declaration is submitted concurrently with the instrument that creates the interest in land.

Registration of Trustee’s Title

The registrar registers the trustee’s title as follows:
