Expropriation Act, R.S.C. 1985, c. E-21, ss. 5 to 14

  • Section 5 of the Expropriation Act (Canada) allows the minister to request that the Attorney General of Canada register a notice of intention to expropriate the interest or right for any interest in land required by the Crown for a public work or other public purpose. The notice is as described in s. 5 and signed by the minister.
  • Section 6 allows for an amendment to a notice or plan registered under s. 5 where it contains any omission, misstatement or erroneous description. In these cases, a corrected notice or plan may be registered and will be deemed to relate back to the day the original notice or plan was registered.
  • Section 12 allows for application to abandon the notice registered in the land title office.
  • Section 14 provides for the Attorney General of Canada to make an application to register a notice of confirmation in the land title office where the notice of intention was registered. If the land to which the notice of confirmation relates is more limited in area than the land described in the notice of intention, the notice of confirmation must be accompanied by a revised plan of the land to which it relates.
  • Each application may be accompanied by a plan defining the area described in the notice or other supporting document.
  • Reference or Explanatory Plan
  • Electronic Submissions: An electronic reference or explanatory plan with a pre-assigned plan number is attached to a Survey Plan Certification form signed electronically by a British Columbia Land Surveyor. The Survey Plan Certification accompanies the electronic Application to Deposit Plan at Land Title Office. These forms are available at ltsa.ca.
  • Notice of Intention to Expropriate (Federal)
  • Electronic Submissions: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Notice of Intention to Expropriate (Federal), and attach an image of the original Notice of Intention to Expropriate.

  • Notice of Amendment to Notice of Intention to Expropriate (Federal)
  • Electronic Submissions: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Amendment of Federal Notice of Intention to Expropriate, and attach an image of the original Notice of Intention to Expropriate.
  • This transaction receives preliminary examination prior to receiving immediate application number, date, and time.
  • Notice of Abandonment (Federal Expropriation)
  • Electronic Submissions: On the Form 17 Cancellation of Charge, Notation or Filing, select Nature of Interest, Notice of Abandonment (Federal Expropriation), and attach an image of the original Notice of Abandonment.
  • Notice of Confirmation Expropriation Act—Fee Simple (Federal)
  • Electronic Submissions: On the Form 17 Fee Simple, select Nature of Interest, Expropriation Act Notice of Confirmation (Federal), and attach an image of the original notice of confirmation of intention to expropriate. The original notice must be signed by the minister.
