Utilities Commission Act, R.S.B.C. 1996, c. 473

The Act establishes the Utilities Commission for the purpose of regulating public utilities, related carriers and processors, and electricity transmissions in the province. The commission is authorized to issue licences and permits and to make orders for the payment of money, costs, or penalties. A certified copy of the commission’s order may be registered in the land title office.

• Nature of Interest: Certified copy of order, once registered, constitutes a lien and charge on the land of the person ordered to make payment.
• Effect of Registration: Lien and charge applies to all land of the debtor in the land title district in which the order is registered.
• Electronic Submissions: On the Form 17 Charge, Notation or Filing, select Nature of Interest, Crown Lien, and attach an image of the original certificate under the Utilities Commission Act.
• Procedure for Enforcement: Lien and charge, once registered, has the same effect as a judgment of the Supreme Court under the Court Order Enforcement Act.
