- 2 (1) This Act and the regulations are not subject to any other enactment, whenever enacted, except the Interpretation Act, the Environment and Land Use Act and the Environmental Management Act and as provided in this Act.
- (1.1) Despite subsection (1) and section 3, if a regulation under the Water Sustainability Act requires that the commission consider a water sustainability plan in making decisions in relation to an area that is subject to the water sustainability plan, the commission must comply with the regulation.
- (1.2) Subsection (1) does not apply in relation to the Haida Nation Recognition Act and, despite section 3 of this Act, the Haida Nation Recognition Act prevails to the extent of any conflict or inconsistency with this Act.
- (1.3) Subsection (1) and section 3 do not apply in relation to the Renewable Energy Projects (Streamlined Permitting) Act.
- (2) Despite section 14(2) of the Interpretation Act, this Act binds the government.

CROSS REFERENCES AND OTHER SOURCES OF INFORMATION
A 2024 amendment to s. 2 made s. 2(1) inapplicable in relation to the Haida Nation Recognition Act, S.B.C. 2023, c. 24, which came into force by B.C. Reg. 162/2024 effective July 18, 2023, and that Act prevails over this Act to the extent of any conflict or inconsistency. That Act recognizes the inherent governance and self-determination rights of the Haida Nation and recognizes the Council of the Haida Nation as its government.
A 2025 amendment to s. 2 made s. 2(1) and s. 3 inapplicable in relation to specified renewable energy projects; see Renewable Energy Projects (Streamlined Permitting) Act, S.B.C. 2025, c. 12, which came into force by B.C.
