In This Volume

  • 101 On application, the Supreme Court may order the appropriate registrar to cancel or postpone a notice of agreement under section 99, or discharge or postpone a registration in relation to a manufactured home under section 100, as applicable, if a spouse
  • (a) cannot be located, after a reasonable search is made,
  • (b) unreasonably refuses to
    • (i) sign or file a cancellation notice under section 99(3), or
    • (ii) register a financing change statement under section 100(2)(b), or
  • (c) is a person with a mental disorder.

Registration of Orders under Section 101

Cancellations

On the Form 17 Cancellation of Charge, Notation or Filing, select Nature of Interest, Notice of Property Agreement (Court Order), and attach an image of the court certified copy of the court order.

Postponements

On the Form 17 Charge, Notation or Filing, select Nature of Interest, Postponement Agreement (Court Order), and attach an image of the court certified copy of the court order.
