43 Agreements Respecting Municipal Equipment On Utility Poles

43 (1) A council may require a person who is permitted to erect poles on highways to provide reasonable accommodation on the poles for wires and equipment of the municipality on agreed terms, and section 174 does not apply to the agreement.

  • (2) If the parties are unable to reach an agreement under subsection (1), the matters must be settled by arbitration, and for that purpose the Arbitration Act applies.
