Overview Of Land Surveys Legislation

The Land Survey Act, R.S.B.C. 1996, c. 247 deals with land surveys including requirements for establishing boundaries and parcels, monumentation, subdivisions, and the statutory responsibilities of the Surveyor General. Under the provisions of the Land Survey Statutes Amendment Act, 2004, S.B.C. 2004, c. 21, the authority for making survey rules has been delegated to the Association of British Columbia Land Surveyors.

GENERAL EFFECT ON LAND TITLE PRACTICE

Plans that are submitted for registration to the land title office must comply with rules authorized under s. 385(5) of the Land Title Act, R.S.B.C. 1996, c. 250. Under s. 75 of the Land Surveyors Act, the relevant rules are set out in the Survey and Plan Rules. These rules are made by the Association of British Columbia Land Surveyors, approved by order of the Surveyor General, and available online at www.abcls.ca.
