8 (1) To secure repayment of money advanced in respect of land, the minister may file in the land title office for the district in which the land is located a certificate showing the following:

  • (a) the date the money was advanced;
  • (b) the amount of money advanced;
  • (c) a summary of any terms and conditions of repayment or forgiveness that are not contained in the regulations;
  • (d) a description of the land sufficient to identify it in the land title office records.
  • (2) On receiving a certificate under this section, the registrar must file it without fee and make reference to it in the proper register against the title to the land described in the certificate.
  • (3) For the purposes of subsection (2) the registrar must not register a transfer or conveyance of the fee simple in the land, an agreement to transfer the fee simple, or a lease, sublease, assignment of lease or mortgage of the land, except as may be prescribed.
  • (4) If money advanced is repaid, or if it is forgiven under the Financial Administration Act, the minister must file a cancellation of the certificate in the land title office.
  • (5) If the regulations made under section 11 prescribe that an obligation to repay money advanced is to be extinguished on the expiration of a prescribed time or on the happening of a prescribed event, on the expiration of the time or the happening of the event, the minister must file a cancellation of the certificate in the land title office.
  • (6) On receipt of a written request showing the name of the person to whom the money was advanced and a description of the land sufficient to identify it, the minister must issue a statement showing the terms and conditions of the advance and the amount owing to the government in respect of it as of the date of the statement.

PRACTICE

Permitted Dealings

The registrar allows registration of the following transactions where a certificate under s. 8 of the Ministry of Lands, Parks and Housing Act is registered against land:

  1. a transmission;
  2. a foreclosure;
  3. an assignment or cancellation of a first mortgage; and
  4. a modification of a first mortgage, unless the modification agreement increases the principal sum due under the first mortgage.

Note in the case of a foreclosure that a notice under the Ministry of Lands, Parks and Housing Act may be merged in the usual manner if it is filed after the foreclosure certificate of pending litigation, or if it is filed before the foreclosure certificate of pending litigation where the provincial Crown has been made a respondent.

Application to Discharge Certificate

Where an applicant applies for registration of a transaction that would otherwise not be permitted under s. 8 and the applicant has applied to the minister responsible for the Ministry of Lands, Parks and Housing Act to issue a consent or release, the registrar normally:

  1. requires satisfactory evidence that the applicant has repaid the advance or requested the minister’s consent to the transaction;
  2. accepts the application and holds it on a pending basis, pending receipt of the consent or release;
  3. contacts the applicant for an explanation if the registrar does not receive the consent or release within an appropriate time; and
  4. issues a s. 308 notice under the Land Title Act and refuses to register for non-filing of the consent or release if the consent or release has still not been received.

Submissions

On the Declaration form, attach an image of the original consent letter from the minister responsible for the Ministry of Lands, Parks, and Housing Act or an authorized signatory from the B.C Housing Management Commission to an Affordable Housing Agreement.

Where consent is required in support of a disposal of land, the electronic Declaration with the attached image of the consent is submitted immediately following the electronic document it supports.
