Part 9 of the Homeowner Protection Act, S.B.C. 1998, c. 31 established a reconstruction program to provide financial assistance to eligible homeowners whose homes had deteriorated sooner than expected as a result of premature building envelope failures. No new applications have been accepted since July 2009. Effective April 1, 2010, the Homeowner Protection Office was wound up and responsibility for the administration of the reconstruction loan portfolio was transferred to the Minister of Finance or BC Housing as agent for the Minister of Finance.

GENERAL EFFECT ON LAND TITLE PRACTICE

The indebtedness of the homeowner is registered as a mortgage that is assigned priority from the date of registration in the usual way.
