  • 3 (1) This Act, except Parts 7 and 8, applies to the Strata Property Act, unless inconsistent with that Act.
  • (1.1) Despite subsection (1), provisions of Parts 7 and 8 of this Act apply to the Strata Property Act if stated to apply by the Strata Property Act.
  • (2) Part 9 of this Act applies to the Strata Property Act only to the extent expressly stated in the Strata Property Act or in Part 9.

Application of Part 7 to Strata Property Act

Part 7 of the Land Title Act, ss. 58 to 120, deals with descriptions and plans. See the following provisions of the Strata Property Act with respect to the application of Part 7 to strata plans.

Cancellation of Plans under Strata Property Act

Part 8 of the Land Title Act, ss. 121 to 137, deals with the cancellation of plans. Section 287 of the Strata Property Act provides that the plan cancellation provisions of the Land Title Act do not apply to a strata plan deposited under the Strata Property Act. See Part 16 of the Strata Property Act, ss. 272 to 289, for the provisions with respect to plan cancellation and the winding up of a strata corporation, and see the Bare Land Strata Plan Cancellation Regulation, B.C. Reg. 556/82, for provisions with respect to the cancellation of a bare land strata plan.

Air Space Plans under Strata Property Act

Part 9 of the Land Title Act deals with the creation and subdivision of air space plans. Section 146(2), in Part 9, provides that Part 7 of the Land Title Act does not apply to an air space plan. Section 141, in Part 9, provides that an air space parcel may be subdivided in accordance with the Strata Property Act.
