Part 24.1 of the Act establishes title registration systems for lands that are subject to the Nisga’a Final Agreement. The agreement took effect on May 11, 2000.

GENERAL EFFECT ON LAND TITLE PRACTICE

The agreement refers to three different types of land. Category A and B Lands are to be registered in the provincial land title system and subject to the provincial Torrens system. The third type of lands, the Nisga’a Lands, will be administered under a Nisga’a land title system. The provincial Torrens system will only apply to Nisga’a Lands that are registered in the provincial land title system.

Practices and procedures for the registration of Nisga’a Lands are being developed at this time. Further commentary on Part 24.1 will be included in future updates to the Manual.
