Form A Freehold Transfer

The director has approved the use of Form A for the transfer of a freehold estate. The use of Form A is compulsory. Item 1 of Form A incorporates the application to register.

Transfer Containing an Exception, Reservation, or Condition

See the Freehold Transfer Form A Land Title Web Filing Form Practice Guide or the Completion Instructions for Hardcopy Transfer Forms (at ltsa.ca), which provide that, on submission of a freehold transfer in Form A to the land title office, a separate application is not necessary unless the transfer also contains an exception, reservation, or condition in favour of, or for the benefit of, the transferor that is an interest in land capable of registration under the Land Title Act. In that case, the transferor must apply to register that interest in Form 17. See also s. 181 of the Act regarding the registration of the fee simple and other interests in such circumstances.

Submissions

For an electronic submission of a Form A that contains an Exception, Reservation, or Condition, the Exception, Reservation, or Condition must be clearly defined in an electronic Form E. The transferor must apply to register that interest in an electronic Form 17 Charge, Notation, or Filing.
